Personal data means any information about an individual from which that person can be identified.

We use different methods to collect personal data from and about you including through:

How we use your information

Lawful basis

The law requires us to have a lawful basis for collecting and using your personal data. We primarily rely on one or more of the following lawful bases:

  • Performance of a contract with you: Where we need to process your personal data to perform a contract we are about to enter into or have entered into with you. In many cases, the contract will be the organisation you represent rather than you personally, but we may still need to process your personal data in order to provide the Website and related services to that organisation.

  • Legitimate interests: Where it is necessary to process your personal data for our legitimate interests (or those of a third party), provided that those interests are not overridden by your fundamental rights and interests. This may include operating, maintaining, and improving the Website, managing relationships with suppliers and buyers, and ensuring the security of our services.

  • Legal obligation: Where it is necessary to process your personal data to comply with a legal obligation that we are subject to, including regulatory and compliance requirements.

Who we give your information to

When we share your personal data with third parties who act as our service providers, we only disclose personal data that is necessary for them to provide their services. We require all such third parties to respect the security of your personal data and to treat it in accordance with applicable law. We do not permit our service providers to use your personal data for their own purposes and only allow them to process it for specified purposes and in accordance with our instructions.

We may share your personal data with:

  • Any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, who support our processing of personal data under this policy.

Other disclosures we may make

We will disclose your personal information to third parties:

  • In the event that we sell or buy any business or assets, in which case we will disclose your personal data to the prospective seller or buyer of such business or assets;

  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, such as to the police, HMRC or any other public authority; or

This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction and to prevent cybercrime.

Where we store your information

The data that we process in relation to you may be transferred to, and stored at, a destination outside the United Kingdom ("UK") or European Economic Area ("EEA") that may not be subject to equivalent data protection law. It may also be processed by staff situated outside the UK or EEA who work for us or for one of our suppliers.

Where your information is transferred outside the UK or EEA, we will take all steps reasonably necessary to ensure that your data is subject to appropriate safeguards, such as one or more of the following:

  • the transfer is to a country which has been granted adequacy status by the UK Secretary of State under the UK GDPR;

  • we have entered into the UK International Data Transfer Agreement (IDTA) or the UK Addendum to the EU Standard Contractual Clauses with the recipient; or

  • another lawful transfer mechanism recognised under applicable data protection law applies.

You may request further information about the safeguards we have in place for international transfers, including copies of any relevant transfer agreements, by contacting support@drinksbox.com.

How we protect your information

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a legitimate business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

How long we keep your information

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. We generally do not retain personal data for longer than 6 years unless a longer retention period is required or permitted by law.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

In some circumstances you can ask us to delete your data: see the "Your rights" section below for further information.
